1. Site Information. Aurora Inn, with its principal place of business at 302 E. Front Street, Nome,AK 99762, provides this website for its visitors and customers (the “Site”). These Terms and Conditionsapply to the use of this Site.
2. Use of Site. You may not use the services of this Site if you (A) do not agree to these terms andconditions; (B) are not at least 18 years of age; (C) are not competent or otherwise unable to enter intoa contract; and/or (D) are prohibited from accessing or using this Site or any of this Site’s contents,goods, or services by law or legal order.
3. Monitoring. You agree that you will not use or implement any device or process to monitor orcopy the Site or the Site’s content or information without Aurora Inn’s express written permission. Youfurther acknowledge and agree that you will not interfere with or attempt to interfere with the properfunctioning of the website via virus, trojan, worms, or any other means that are intended to damage,intercept, or expropriate any system, data or information that may create liability for Aurora Inn or itscustomers.
4. Trademarks and Copyrights. Nothing in these Terms and Conditions, nor your use of the Site,grants you a license, express or implied, to use the trademarks, patents, copyrights, trade secrets,technologies, or other intellectual property of the Aurora Inn, its sister, or parent companies without theexpress permission of such entities.
5. Passwords and Log-Ins. This Site may permit you to create an account with a username andpassword. You are solely responsible for keeping your username and password confidential and secure.Aurora Inn is not responsible for any activities that take place under your account and you will be heldfinancially and legally responsible for any incurred charges, losses, or damages. Aurora Inn furtherreserves the right to suspend or terminate your account at its sole discretion, with or without notice, inthe event you violate these Terms and Conditions or any rules of the Aurora Inn.
6. Site Transactions. If you choose to book a reservation or service, or purchase a product throughthis Site, you will be asked to provide certain payment information, including but not limited to yourname, credit card information, billing address, etc. By entering this information, you represent andwarrant that you have the legal right to use the credit card, debit card, or other payment method thatyou use in such transaction. Additionally, by submitting the payment information, you grant Aurora Innor the third party collecting the information on Aurora Inn’s behalf the right to provide the informationto all necessary parties to complete or facilitate the transaction on your behalf. You understand and acknowledge that you may be charged at the time you place your order unlessotherwise stated. You agree to pay all charges incurred by you, on your behalf, or by your accountthrough the Site, at the price stated when the transaction is charged, including all applicable taxes,surcharges and fees.
7. Data. Aurora Inn respects the privacy of its guests and handles personal data in accordancewith applicable privacy laws. You understand that Aurora Inn may collect, use, and store personalinformation for the purpose of providing services and improving our guest experience.
8. Warranty. TO THE MAXIMUM EXTENT ALLOWABLE BY LAW, THIS SITE AND THE INFORMATIONPROVIDED ON THE SITE IS PROVIDED “AS IS” AND WITHOUT A WARRANTY OF ANY KIND, EXPRESS ORIMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESSFOR A PARTICULAR PURPOSE, OR NON-INFRIGEMENT. AURORA INN MAKES NO WARRANTIES,GUARANTEES, OR ASSURANCES THAT ITS SITE AND/OR ITS INFORMATION WILL BE AVAILABLE,ADEQUATE, ACCURATE, UNINTERRUPTED, COMPLETE, OR ERROR-FREE AT ANY PARTICULAR TIME, FORANY PARTICULAR REASON. AURORA INN IS NOT RESPONSIBLE FOR ANY MALICIOUS OR UNAUTHORIZEDCODE. YOU ARE RESPONSIBLE FOR ENSURING YOUR DEVICES (E.G., COMPUTER, LAPTOP, SMARTPHONE,ETC.) ARE SECURE AND HAVE THE APPROPRIATE SCANNING AND PROTECTIVE MECHANISMS. BY USINGTHIS SITE AND/OR RELYING ON ANY INFORMATION ON THIS SITE, YOU ASSUME ALL RISKS OF LOSS THATMAY ARISE WITH SUCH USE.
9. Limitation of Liability. You agree that Aurora Inn shall not, under any circumstances, be liable forany damages of any kind arising out of, in connection with, or relating to the use of or inability to use theSite, including any liability (A) as a publisher of information; (B) as a booking agent; (C) for any incorrector inaccurate information; (D) for any unauthorized access to or disclosed of your transmissions or data;(E) for statements or conduct of any third parties; or (F) for any other matter relating to the Site or anythird party website or application. This is a comprehensive limitation of liability that applies to alldamages of any kind, including any direct, indirect, special, incidental, or consequential damages, as wellas those that may arise from loss of business, loss of profits, loss of goodwill, loss of use, loss of data,etc., whether based on breach of contract, tort, breach of warranty, or otherwise, even if the individualadvises of the possibility of such damages. However, notwithstanding the foregoing, in the event the Aurora Inn is deemed liable for any damagesrelated to the use of this Site, your sole and exclusive remedy is limited to the reimbursement of thecharges for services or products paid for by you.
10. Indemnification. You agree to indemnify and defend Aurora Inn against any demands, claims,or causes of action that are brought against it or arise as a result of your breach or violation of theseTerms and Conditions, including any activity related to your account by you or another person.
11. Confidentiality. You understand that you have no right to confidentiality in yourcommunications with Aurora Inn and Aurora Inn has no obligation to protect your communications fromdisclosure. Aurora Inn is free to use, disclose, and distribute your feedback, comments, questions, andsuggestions for any purpose whatsoever.
12. Errors and Inaccuracies. Site information may contain errors and/or inaccuracies, including butnot limited to mistakes relating to pricing or the availability of particular rooms or suites. Aurora Innreserves the right to make changes, corrections, cancellations, and/or improvements to the informationon this Site and the services or products described in such information, with or without notice.
13. Governing Law and Jurisdiction. These Terms and Conditions shall be governed by and enforcedin accordance with the laws of the State of Alaska without regard to its conflict of laws provisions. Any
    dispute or claim arising out of or in connection with these Terms and Conditions or the use of this Siteshall be heard in a court of competent jurisdiction in the State of Alaska.
14. Severability. If any provision of this Agreement shall be deemed unlawful, void, or for anyreason unenforceable by a court of competent jurisdiction, the validity and enforceability of anyremaining provisions shall not be affected.
